Terms and Conditions of Use
App: Scontrino Digitale
These terms govern the use of the Scontrino Digitale app ("the App"), developed by Mobile Safe Apps di Maria Cristina Galeota, Via Sandro Pertini 41, 80038 Pomigliano d'Arco (NA), Italy ("we"). By downloading or using the App you accept these terms. If you do not accept them, do not use the App.
1. What the App is
The App is a point-of-sale tool for merchants and professionals. It lets you:
- issue commercial documents, i.e. receipts, and invoices;
- manage customers, stock, repairs, tables and kiosks;
- connect printers and card readers;
- send commercial documents to the Italian Revenue Agency (Agenzia delle Entrate) through the free "Documento Commerciale Online" procedure, with your Fisconline credentials.
The App is an independent product: it is not made or endorsed by the Agenzia delle Entrate, SumUp or Google.
2. Who can use it
The App is intended for people carrying out a business or self-employed activity. By using it you declare that you are at least 18 years old and that you are acting for your professional activity. For this reason the protections of the Italian Consumer Code reserved for consumers do not apply.
3. Your tax responsibilities
Tax obligations remain yours. In particular:
- Submission to the Agenzia delle Entrate. Receipts are valid as commercial documents only if transmitted to the Agenzia delle Entrate, either directly from the App with direct issuing enabled or through a telematic cash register. If submission is turned off, the App shows it and the documents stay only on the device ("Local only").
- Checking outcomes. You must check that submissions succeeded. Receipts marked "Queued" or "Error" must be sent again.
- Correct data. You are responsible for the VAT rates, natures, tax regime, customer data and amounts you enter or configure.
- Electronic invoices. The App prepares the e-invoice file, but you send it to the Exchange System (Sistema di Interscambio) yourself, from your PEC or through your intermediary.
- Retention. Legally compliant retention of documents is your responsibility. The App is not a substitute retention (conservazione sostitutiva) system.
The App does not provide tax or legal advice. If in doubt, consult your accountant.
4. Credentials and third-party services
For some functions the App uses third-party services with your accounts:
- Agenzia delle Entrate (Fisconline);
- SumUp, for card payments;
- Google Drive, for backups;
- Google Play, for the subscription.
Those services are governed by their own terms. We are not responsible for their availability, their changes or their outcomes: for example a payment declined by SumUp or an Agenzia service that cannot be reached. Keep your credentials and the device on which you save them safe.
If a card payment is cancelled or refunded after the receipt has been issued, for example from the SumUp app or website, the App is not notified. You must void the document yourself from Receipt history.
5. Subscription
- What is paid. The App is free to download. Issuing receipts requires the PRO subscription, monthly or yearly, purchased through Google Play.
- Free trial. Where offered, its length is shown on Google Play at the time of purchase.
- Price and renewal. The price is the one shown by Google Play. The subscription renews automatically at expiry unless cancelled at least 24 hours before, from Google Play → Payments & subscriptions.
- Refunds. Payments and refunds are handled by Google Play according to its conditions.
- Changes. We may change prices or the features included in the subscription, with notice through Google Play or in the App. Price changes apply from the next renewal.
6. Your data and backups
The data you enter stays on your device, as described in the Privacy Policy. You are responsible for backing it up, from the App, to Google Drive or to an exported file. We cannot recover data lost through failure, loss or uninstallation, because we do not have a copy. If you set a backup password and forget it, the backup can no longer be recovered.
You are the data controller for your customers' personal data: comply with the GDPR when collecting and using it.
7. Licence
We grant you a personal, non-exclusive and non-transferable licence to use the App for your business. You may not copy, modify, decompile or redistribute the App, nor use our name and trademarks without authorisation, except as permitted by law. The open-source components included remain subject to their own licences, available in About → Licences.
8. Availability and warranties
We work to make the App function correctly, but it is provided "as is". We do not guarantee that it is error-free or always available, nor that it is compatible with every device, printer or reader. Some functions require an internet connection: without a connection receipts stay queued until it returns.
We may update the App and change or suspend its functions, including to adapt it to regulatory changes or changes in the Agenzia delle Entrate's services.
9. Limitation of liability
To the extent permitted by law, we are not liable for indirect damages, loss of profits, loss of data, penalties or interest arising from:
- failed or incorrect transmission of documents;
- incorrectly entered data;
- use of the App not in accordance with these terms;
- unavailability of third-party services or of the connection.
In any case our total liability does not exceed what you paid for the subscription in the 12 months preceding the event. Cases of wilful misconduct or gross negligence, and other cases in which the law does not allow limitations, are not affected.
10. Changes to the terms
We may update these terms. The version in force is always on this page, with the date at the top. In case of important changes we will let you know in the App. By continuing to use it after the change, you accept the new terms.
11. Governing law and jurisdiction
These terms are governed by Italian law. The Court of Nola has exclusive jurisdiction over any dispute.
